Divorce Information
If a marital asset such as a home cannot be divided physically, one option is
to put it on the open market and divide the equity and profit gained by the
transaction. It is critical to have a Real Estate professional evaluate the
property and the situation to satisfy all parties to the real worth.
Questions I will ask you prior to the sale of your home:
- What is in your best interest?
- To sell and split the proceeds?
- To stay and buy out the other partner?
- Is selling a necessity at this time?
- Is now the best time to sell?
- Are there dependants: children, elderly?
- What is the school/care situation?
- Does the matrimonial home now become too large for the new family
circumstances?
- Is it still affordable and manageable to carry?
- Can they keep up with the maintenance?
- Would a change of residence assist in the healing process?
- What do you estimate your house to be worth in today's market?
- Does the home require touching up: painting, etc.?
- Does the home require repairs?
- Who will do this?
- What is the best location for you?
- Is it important to stay in the same (or similar) area?
- Consider schools, care facilities, changed social situation, family
shared custody, etc.
If the decision is made to sell, you must:
Discuss a reasonable and realistic time frame for preparation of the sale.
Discuss a reasonable and realistic time frame for the price and sale of the
home.
- Once the house is on the market, you must be ready for appointments.
Lastly you must prepare yourself for the acceptance of an offer.
- You should also choose a Real Estate Professional who can work well not only with
your real estate lawyer, but your family lawyer too. There are several
complications to a Real Estate transaction involving separation that I am
experienced and trained to deal with.
By covering all elements it enables you to have a clear and more realistic
approach to the market value and marketing of your home while not feeling
disenfranchised or hurt by the process.
